This store and website — together with all the information, content, features, tools, products and services we make available through them (the "Services") — is operated by opellier inc., trading as Opellier. Our storefront runs on Shopify's platform, which is what enables us to offer the Services to you.

This Privacy Policy sets out what personal information we collect, what we do with it, and who we pass it to, whenever you visit the Services, buy something through them, or get in touch with us. Where this policy and our Terms of Service disagree on anything to do with collecting, processing or disclosing your personal information, this policy prevails.

Please read it properly. By using or accessing any part of the Services you confirm that you have read it and that you understand how your information is collected, used and disclosed as described here.

Information We Collect

By "personal information" we mean information that identifies you, or that could reasonably be connected back to you or to another person. Information collected anonymously, or stripped of identifiers so that it can no longer reasonably be linked to you, is not personal information. Depending on how you use the Services, where you live, and what applicable law permits or requires, we may collect or process the following categories — along with inferences drawn from them:

  • Contact details — your name, address, billing address, shipping address, telephone number and email address.
  • Financial information — credit card, debit card and financial account numbers, payment card details, financial account details, transaction details, method of payment, payment confirmations and other payment data.
  • Account information — your username, password, security questions, preferences and settings.
  • Transaction information — the items you view, add to your cart or wishlist, buy, return, exchange or cancel, and your purchase history with us.
  • Your communications with us — whatever you include when you write to us, for example in a customer support enquiry.
  • Device information — details of your device, browser and network connection, your IP address and other unique identifiers.
  • Usage information — how and when you interact with the Services and move around them.

Where That Information Comes From

We may collect personal information:

  • From you directly — when you open an account, visit or use the Services, write to us, or otherwise hand us your information;
  • Automatically through the Services — from your device when you browse our site or use our products and services, including through cookies and comparable technologies;
  • From our service providers — where we have engaged them to run certain technology for us, or where they collect or process information on our behalf;
  • From our partners and other third parties.

Why We Use It

Depending on how you deal with us and which of the Services you use, we may use personal information for these purposes:

  • Running, tailoring and improving the Services. To deliver the Services and perform our contract with you: taking payment, fulfilling your order, remembering your preferences and the pieces you are interested in, sending you notifications about your account, processing purchases, returns, exchanges and other transactions, creating and managing your account, arranging shipping, handling returns and exchanges, letting you post reviews, and building a shopping experience suited to you — for instance by recommending lighting related to what you have already bought. The same information helps us improve the Services generally.
  • Marketing and advertising. To send you marketing, advertising and promotional messages by email, text message or post, and to show you online advertisements for products or services, whether on the Services or elsewhere — including advertisements based on what you have previously bought or added to your cart, and on your other activity with us.
  • Security and fraud prevention. To authenticate your account, keep payment and shopping secure, and detect, investigate or act on activity that may be fraudulent, illegal, unsafe or malicious, as well as to protect public safety and secure our systems. If you register an account, keeping your credentials safe is your responsibility — we strongly recommend you never share your username, password or other access details with anyone.
  • Communicating with you. To give you customer support, respond to you properly, serve you effectively and maintain our working relationship with you.
  • Legal reasons. To comply with the law or respond to valid legal process, including requests from law enforcement and government agencies; to take part in civil discovery, actual or potential litigation and other adversarial proceedings; and to enforce or investigate suspected breaches of our terms and policies.

Who We Share It With

In certain situations we may disclose your personal information to third parties for legitimate purposes, subject to this policy. Those situations include:

  • Shopify, our vendors and other third parties who perform services for us — for example IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping.
  • Business and marketing partners, so that they can provide marketing services and advertise to you. We use Shopify to support personalised advertising with third-party services, based on your online activity across different merchants and websites. These partners handle your information under their own privacy notices. Depending on where you live, you may have the right to tell us not to share information about you for targeted advertising of this kind — you can opt out here.
  • Recipients you choose, where you direct us, ask us or otherwise consent — for instance a carrier who ships your order, or a social media widget or login integration you decide to use.
  • Our affiliates and others within our corporate group.
  • In connection with a business transaction such as a merger or insolvency; to meet legal obligations including subpoenas, search warrants and similar demands; to enforce applicable terms or policies; and to protect or defend the Services, our rights and the rights of our users and others.

Payment Security and Three Things We Do Not Do

Because several of the questions we are asked most often come down to the same worries, we will answer them here directly:

  • Card details are only ever collected over an encrypted connection. Every page of this site, checkout included, is served over HTTPS using TLS/SSL encryption, and the payment details you enter are passed to our payment processors over that encrypted channel.
  • We do not sell your contact details. We do not exchange your name, address, telephone number or email address for money. We do use Shopify's personalised advertising features, which some privacy laws classify as "sharing" personal information for targeted advertising; if you would rather we did not, opt out here and we will stop.
  • We do not use your personal information or your photographs in our advertising without your consent. If we ever want to feature something you have sent us, we will ask you first.
  • Collecting personal information is not the point of this website. We are a lighting retailer. We ask for information only so that we can take your order, deliver it, support you afterwards and meet our legal obligations.

Our Relationship with Shopify

Shopify hosts the Services, and collects and processes personal information about how you reach and use them in order to run and improve them for you. What you submit through the Services is transmitted to and shared with Shopify, and with third parties that may sit in countries other than the one you live in, so that the Services can be provided and improved.

In addition, to help protect, grow and improve our business, we use certain Shopify enhanced features that draw on data from your interactions with our store, with other merchants and with Shopify itself. To provide those features Shopify may use personal information collected about those interactions. Where that happens, Shopify is the party responsible for processing your personal information, including for answering requests to exercise your rights over that use. Other Websites We Link To

The Services may link to websites and other online platforms run by third parties. If you follow a link to a site we neither own nor control, read its privacy and security policies and its other terms before going further. We cannot guarantee, and are not responsible for, the privacy or security of those sites, nor for the accuracy, completeness or reliability of anything on them.

Anything you post in a public or semi-public place, including on third-party social networks, may also be visible to other users of the Services and of those platforms, without limitation on how we or a third party may use it. The fact that we link to a platform does not by itself mean we endorse it, its content, its owners or its operators, unless we say so on the Services.

Children

The Services are not meant for children, and we do not knowingly collect personal information from anyone below the age of majority in their jurisdiction. If you are the parent or guardian of a child who has given us their personal information, contact us using the details at the end of this policy and we will delete it.

As at the date of this policy, we have no actual knowledge that we "sell" or "share" — as applicable law defines those terms — the personal information of anyone under 16 years of age.

Keeping and Protecting Your Information

No security measure is perfect or impenetrable, and we cannot promise "perfect security". Information you send us may also be exposed while in transit. We would therefore ask you not to use insecure channels to send us anything sensitive or confidential.

How long we keep your personal information depends on the circumstances: whether we still need it to maintain your account or provide the Services, how long the law requires us to hold it, and whether it is needed to resolve a dispute or enforce our contracts and policies.

Your Rights and Choices

Depending on where you live, some or all of the following rights may apply to your personal information. They are not absolute, they may only apply in particular circumstances, and in some cases we may refuse a request where the law allows us to.

  • Right to access / know. You may be able to ask for access to the personal information we hold about you.
  • Right to delete. You may be able to ask us to delete personal information we hold about you.
  • Right to correct. You may be able to ask us to correct personal information about you that is inaccurate.
  • Right to portability. In certain circumstances, and with certain exceptions, you may be able to receive a copy of the personal information we hold about you and ask us to transfer it to someone else.
  • Right to opt out of sale or sharing for targeted advertising. Depending on where you live, you may have the right to opt out of the "sale" or "sharing" of your personal information, or of its processing for what privacy law calls "targeted advertising". You can opt out here. If you visit our website with the Global Privacy Control opt-out preference signal switched on, then depending on where you are we will automatically treat that as an opt-out request for the device and browser you are using; where we can match that signal to a Shopify account, we will apply it to the account as well. You can read about Global Privacy Control at globalprivacycontrol.org. Apart from Global Privacy Control, we do not act on other "Do Not Track" signals sent by browsers or devices.
  • Managing what we send you. We may send you promotional emails, and you can stop them at any time using the unsubscribe link in any of them. Opting out of promotional email does not stop non-promotional messages, such as those about your account or an order you have placed.

We will not treat you differently for exercising any of these rights. Before acting on a request we may need to verify your identity, as applicable law permits or requires. Where the law allows it, you may appoint an authorised agent to make a request for you; before we accept such a request we will require the agent to prove you have authorised them, and we may still need to verify your identity with you directly. We will respond within the time applicable law allows.

Complaints

If you are unhappy with how we handle your personal information, please contact us using the details below. Depending on where you live, you may also have the right to appeal a decision of ours — again by contacting us — or to complain to your local data protection authority.

Transfers Outside Your Country

We may transfer, store and process your personal information outside the country you live in.

Where we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses, or the equivalent contracts issued by the relevant competent UK authority — unless the destination country has been formally determined to offer an adequate level of protection.

Changes to This Policy

We may update this Privacy Policy from time to time, to reflect changes in our practices or for operational, legal or regulatory reasons. When we do, we will post the revised version on this website, change the "Last updated" date at the top, and give notice where applicable law requires it.
